According to the application filed by the AG to challenge the sentence, the Judge erred in his judgement because there was an error on the face of the record.
The state is therefore requesting for a retrial and a thorough examination of the convict.
As can be recalled, Charles made certain statements during his trial which many people believe clearly indicate that he wasn’t well mentally. There was therefore the believe that the judge should have ordered for a psychiatric evaluation of the convict before sentencing him.
